Law Enforcement Guidelines

These guidelines are provided for use when seeking information from or asking that action be taken by Euclid Labs, Inc. (“Magic Eden”) in connection with users of Magic Eden’s products or services or items listed on Magic Eden’s website (magiceden.io).

Magic Eden respects the rules and laws of the jurisdictions in which it operates, as well as the privacy and rights of its users. Accordingly, Magic Eden provides information or takes action only in response to government or law enforcement requests and only when we reasonably believe that we are legally required to do so. To protect our user’s rights, we carefully review requests to ensure that they comply with the law and are within the powers of the requesting authority or law enforcement official. All requests from government and law enforcement agencies must comply with applicable laws. Magic Eden will provide information or take action only in response to legally valid process. For private party requests, Magic Eden complies with the laws pertaining to customer data and provides data as legally required.

These guidelines are intended to serve as an informational resource and do not create obligations or waive any objections concerning how Magic Eden will respond in any particular case or request. Magic Eden reserves the right to seek reimbursement for the costs associated with responding to government or law enforcement requests, where appropriate. Nothing within these Guidelines is meant to create any enforceable rights against Magic Eden, and Magic Eden’s policies may be updated or changed in the future without further notice.

Stolen Property

The sale of stolen property is not allowed on Magic Eden’s website. If you see stolen property on Magic Eden’s website, contact law enforcement immediately.

Magic Eden will only respond to inquiries regarding stolen property from government or law enforcement agencies. Magic Eden may take action consistent with applicable laws and the Magic Eden Terms of Service and Privacy Policy, and may be legally required to do so by court order or government agency. Such actions may include flagging or removing a listing, restricting account activity or account suspension.

Requests for Information

To obtain information from Magic Eden, government and law enforcement officials must provide legal process appropriate for the type of information sought, such as a subpoena, court order, or a warrant. Magic Eden can provide information in so far as Magic Eden still possesses the requested information pursuant to its data retention policies and as necessary to fulfill the purposes outlined in our Privacy Policy.

While we agree to accept service of public authority and law enforcement requests by these methods, neither Magic Eden nor our customers waive any legal rights based on this accommodation. Each request must include contact information for the authorized public authority or law enforcement agency official submitting the request, including:

  • Requesting agency name

  • Requesting agent name and badge/identification number

  • Requesting agent employer-issued email address

  • Requesting agent phone contact, including any extension

  • Requesting agent mailing address (P.O. Box will not be accepted)

  • Requested response date (see details below for emergency requests)

Please note that requests seeking testimony must be personally served on our registered agent for service of process. We do not accept such requests in person or via email.

Notice

Magic Eden will notify users when information is being sought in response to legal process from government, law enforcement, or third parties, except where providing notice is explicitly prohibited by the legal process itself, by a court order Magic Eden receives, or by applicable law.

Magic Eden will notify users when their Magic Eden account or activity on the Magic Eden website has been restricted/deleted as a result of Magic Eden receiving a court order demonstrating that the account or activity to be restricted/deleted was used unlawfully or in violation of Magic Eden’s Terms of Service; except where providing notice is prohibited by the legal process itself, by a court order Magic Eden receives, or by applicable law.
